नेपाली सङ्गीतको प्रतिलिपी अधिकारः चुनौती र समाधानका उपायहरू

Abstract

वर्तमान समयमा सङ्गीत उपभोगको परम्परागत पद्धतिलाई डिजिटल पद्धतिले विस्थापित गरेका कारण सङ्गीत उत्पादन, वितरण र प्रदर्शनका गतिविधिहरु सरलता तर्फ उन्मुख भएको छ । प्रविधिको विकाशले सङ्गीतको विकाशसंगै प्रतिलिपि अधिकारको रक्षा जस्ता यसले चुनौतिहरुको सिर्जना गरेको छ । जसका कारण प्रतिलिपी अधिकार उलङ्घनको घट्नाहरु क्रमिक रुपमा बढ्दै गएका छन । प्रतिलिपि भनेको सिर्जनात्मक कार्यको हुबहु नक्कल गर्नु हो, र अधिकार भनेको कानूनी वा नैतिक विशेष सुविधा हो । नेपाली सङ्गीतको प्रतिलिपी अधिकार चुनौती र समाधानका उपायहरु विषयमा गरिएको यस अनुसन्धानात्मक अध्ययनले प्रतिलिपी अधिकारसँग सम्बन्धित प्रमुख समस्याहरूको बारेमा व्याख्या तथा विश्लेषण गर्दै व्यावहारिक हिसाबले समाधानका मार्गहरु खोजी गर्ने प्रयास गरेको छ । नेपाली सङ्गीत क्षेत्रमा डिजिटल पद्धतिसंग सम्बन्धित अधिकार उत्पन्न भएको चुनौती र समाधानका उपाएहरुका सम्बन्धमा प्रस्तुत आलेख तयार पारिएको छ । मुख्यत आईटी विज्ञसंगको अन्तरवार्ता र पुर्व प्रकाशित लेख, रचना र पुस्तकहरुलाई आधार मानेर यस अनुसन्धनात्मक कार्यलाई सम्पन्न गरिएको छ । प्रस्तुत लेख विषेशत सङ्गीत सर्जक, स्रोता, उत्पादक, वितरक लगायत अध्ययनकर्ताहरुको लागि पनि सहयोगी हुनेछ ।

At present, due to the traditional method of music consumption being replaced by digital method, the activities of music production, distribution and performance have become oriented towards simplicity. As technology has evolved, music has also evolved, creating challenges such as protecting copyright rights. Due to which the incidents of copyright infringement gradually increased. Copy means copying a creative work exactly, and rights means legal or moral special privilege. In this research study conducted on the challenge of copyright rights in Nepali music and its solution, an attempt has been made to explain and analyze the major problems related to copyright and find ways to solve them in a practical manner. The presented article has been prepared regarding the challenges that have arisen related to the digital system in the Nepali music sector and the solutions to them. This research work has been carried out mainly based on interviews with IT experts and previously published articles, writings and books. The presented article will also be helpful for the creators, sources, producers, distributors and researchers of special music.
